YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT

SUBMIT A CLAIM

If you are a Class Member, you can submit a Claim Form to receive Settlement Benefits. You can mail, email, or fax a completed claim form or you can submit a claim form online here by using your CPT ID and CLASS MEMBER PASSCODE which can be found on your Claim Form. Please refer to Questions 8-10 in the FAQs for more details.

EXCLUDE YOURSELF FROM THE SETTLEMENT

If you exclude yourself from the Settlement, you will not receive any Settlement Benefits. This is the only option that allows you to retain your right to bring another lawsuit against BWW or the Released Parties about the issues in the Lawsuit. The postmark deadline to exclude yourself is April 2, 2019. Please refer to Questions 14-15, and 17 in the FAQs for more details.

OBJECT TO THE SETTLEMENT

If you don’t like the Settlement, you can write to the Court. You may object to the Settlement and also submit a claim for Settlement Benefits. The filing and postmark deadline to send an objection is April 2, 2019. Please refer to Questions 16-17 in the FAQs for more details.

ATTEND THE FINAL HEARING

The Court has set a hearing on June 18, 2019 at 9:00 a.m. regarding the fairness of the Settlement. You may appear at the hearing, but you don’t have to. You may hire your own attorney to appear for you, at your own cost, but you don’t have to. If you choose to appear, you can ask to speak to the Court about why you do not like the Settlement. Please refer to Questions 19-21 in the FAQs for more details.

DO NOTHING

If you do nothing and the Settlement is approved, you will not receive any Settlement Benefits. You will be bound by the Settlement and judgment and will not be able to sue BWW or the Released Parties about the issues in this Lawsuit. Please refer to Question 13 in the FAQs for more details.

WHAT ARE MY OPTIONS?

DO NOTHING

If you do nothing, you will not be a Participating Class Member and you will not qualify to receive a monetary payment, but you will be bound by the release in the Settlement Agreement. 

SUBMIT A CLAIM BY
MAY 1, 2020

In order to qualify to receive a payment under the Settlement, Class Members must submit a Claim that is both (i) timely and (ii) validated by the Settlement Administrator. If you miss the deadline, you will not receive any money under the Settlement, but you will be bound by the other terms of the Settlement if you do not request exclusion from the Settlement 

Request to be excluded from the settlement by may 1, 2020 

Any Class Member who wishes to be excluded from the Settlement must complete and return a request for exclusion via U.S. Mail, email, or personal delivery, and that request for exclusion must be validated by the Settlement Administrator. To exclude yourself from the Settlement, you must follow the instructions on page 4 of the Long Form Notice

You may not submit both a Claim Form and a letter requesting to be excluded from this Settlement. 

Object to the settlement by may 1, 2020 

Any Class Member who wishes to object to the Settlement may do so orally or in writing. Any written objection must be filed with the Court and served on Class Counsel, Defendants’ counsel, and the Settlement Administrator, no later than May 1, 2020. To object to the Settlement, you must follow the instructions on page 4 of the Long Form Notice. If you intend to object to the Settlement but also wish to receive your share of the Settlement if it is approved by the Court, you must also submit a timely and valid Claim Form as explained above.
